2nd Circuit Panel Affirms That EBay Did Not Infringe Tiffany's Trademarks
NEW YORK - Online auction provider eBay Inc. is not guilty of infringing the famous marks of jeweler Tiffany and Co., despite the existence of counterfeit goods on its site, a panel in the Second Circuit U.S. Court of Appeals ruled April 1, mostly affirming a lower court's judgment (Tiffany [NJ] Inc., et al. v. eBay Inc., No. 08-3947, 2nd Cir.; 2010 U.S. App. LEXIS 6735).
