Insurer Had No Obligation Over $1 Million Policy Limits, 2nd Circuit Panel Rules
NEW YORK - Having determined that an excess insurer's umbrella liability policy covered contractual indemnification claims brought in a wrongful death lawsuit, a panel of the Second Circuit U.S. Court of Appeals on April 14 affirmed a lower court's grant of summary judgment to a primary insurer on indemnification, as well as on fiduciary duty and bad faith claims (Ohio Casualty Insurance Co. v.
